1. Eligibility and Access
To use Zammer (“Service”), you must be a registered Shopify merchant, be authorized to bind your business to these Terms, and consent to data processing and message delivery on behalf of your customers. You must have an active Shopify store and enable SMS or RCS messaging features within your store configuration.
2. Service Description
Zammer enables Shopify merchants to send SMS and RCS messages to their customers for purposes such as order updates, abandoned-cart recovery, and promotional engagement. The Service integrates with Shopify’s checkout and marketing systems and connects to supported carrier networks through Twilio or equivalent providers.
3. Merchant Responsibilities
You agree to:
- Use the Service only for lawful and permitted purposes.
- Obtain and maintain all required customer opt-ins before sending any message.
- Include required disclosures (“message frequency may vary,” “message and data rates may apply,” “reply STOP to unsubscribe”).
- Comply with all applicable laws and industry guidelines, including CTIA, TCPA, and GDPR where applicable.
- Not send unsolicited, fraudulent, or prohibited content.
Zammer acts solely as a technology provider and is not the sender of messages initiated by your store.
4. Data and Security
Customer data, including phone numbers and message logs, is processed and stored securely on Hetzner infrastructure within the European Union. Zammer implements commercially reasonable technical and organizational measures to safeguard data. You are responsible for maintaining the security of your Shopify account and API credentials.
5. Fees and Billing
Zammer may offer free and paid tiers. All billing is processed through Shopify’s billing system. Pricing and message costs are disclosed prior to subscription or purchase.
6. Service Availability and Limitations
Zammer strives for high availability but cannot guarantee uninterrupted service or message delivery, which depends on carrier and network performance. Certain geographic or carrier restrictions may apply.
7. Intellectual Property
All software, trademarks, and content associated with the Service remain the property of Itzhak Smocha LTD or its licensors. You retain ownership of your Shopify data and customer content.
8. Termination
You may uninstall the app at any time. Zammer may suspend or terminate access if you violate these Terms, applicable laws, or platform policies.
9. Disclaimer and Limitation of Liability
The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, Zammer shall not be liable for indirect, incidental, or consequential damages arising from the use or inability to use the Service.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict-of-law principles.
Any dispute or claim arising out of or relating to these Terms or your use of the Service shall be brought exclusively in the state or federal courts located in Clark County, Nevada, and you consent to the personal jurisdiction and venue of such courts.
