1. Purpose

This Acceptable Use Policy (“Policy”) defines the standards that apply to all merchants and users (“you,” “your”) who access or use Zammer’s messaging services, including SMS and RCS (“Services”). By using the Services, you agree to comply with this Policy in addition to the Merchant Terms of Service.

2. Prohibited Activities

• Unsolicited or unlawful messages – including spam, phishing, or any communication sent without valid prior consent.
• Fraudulent, deceptive, or misleading content – false offers, impersonation, or misrepresentation of a brand or sender.
• Illegal or regulated materials – weapons, drugs, gambling, counterfeit goods, or other restricted products.
• Harassment, hate, or abusive content – messages that promote violence, discrimination, or exploitation.
• Sexually explicit or adult material.
• Malware or malicious links.
• Collection or resale of personal data without proper consent.
• Message flooding or denial-of-service behavior that disrupts networks.
• Circumvention of carrier or platform restrictions.

3. Consent and Opt-Out Requirements

• Obtain express consent before sending any message.
• Clearly identify the brand or merchant name in each message.
• Include opt-out instructions (“Reply STOP to unsubscribe”) in recurring programs.
• Honor opt-out requests immediately and maintain suppression lists.
• Provide a way for recipients to text HELP for assistance.

Failure to meet these requirements may lead to suspension or termination.

4. Compliance Obligations

You must comply with all applicable laws, regulations, and industry standards, including but not limited to:

• CTIA Messaging Principles and Best Practices
• Telephone Consumer Protection Act (TCPA)
• GDPR, CAN-SPAM, and regional privacy laws
• Carrier-specific A2P 10DLC and RCS policies

Zammer may update its compliance rules in response to carrier or regulatory changes.

5. Security and Abuse

You are responsible for securing your Shopify and Zammer credentials. If you suspect unauthorized use or abuse of the Service, notify us immediately at [email protected].

6. Enforcement

• Investigate violations of this Policy;
• Remove or block offending content;
• Suspend or terminate Service access; and
• Report serious abuse to carriers or authorities when required by law.

Repeated or severe violations will result in permanent account termination.

7. Updates to This Policy

We may modify this Policy from time to time. Updated versions will be posted at https://www.zammer.io/acceptable-use, and continued use of the Services constitutes acceptance of the revised Policy.
